Introduction

Fonterra Lagos (“Fonterra Lagos or We”) run and manage a Beach House, located in llashe, Lagos, Nigeria. It comprises 3 ensuite fully air-conditioned bedrooms, well-furnished kitchen, swimming pool, front and rear balconies, Hot Tub/Jacuzzi and Lounge with well-equipped facilities and amenities (“the Beach House”).

Conditions of Rental

1. The Beach House is available all year round with daily hire charges at prices to be communicated upon request.
2. Check in starts at 11am and check out time is 7pm for Day Bookings and 9am for Overnight Bookings. Due to cleaning out and housekeeping, it is not possible to flex these times and you must be fully packed and have vacated the Beach House by the closing time indicated on your booking.
3. We reserve the right to refuse any booking without giving any reason.
4. Whilst unlikely, we may occasionally have to make changes to your booking and reserve the right to do so. We anticipate these to be minor and will advise you of them as soon as possible.
5. We ask that you and your guests take the time to review the general conditions outlined below as well as our rules and regulations whilst at the Beach House.
6. The booking is made and shall be deemed to be made subject to these terms and conditions and the rules and regulation of the Beach House.
7. Payment of the fees for the use of the Beach House indicates acceptance of these terms and conditions as well as the rules and regulations of the Beach House.
8. Payment of the fees for the use of the beach also indicates that the terms and conditions as well as the rules and regulations of the Beach House are binding on the Hirer and all users either guests, vendors or invitees of the Hirer.
9. We hope you have a pleasant time at Fonterra Lagos, however Management through our security reserves the right to revoke admission to any group not complying with our rules and regulations.

Hirer/Number Composition

1. The person who completes the booking, i.e. the lead name, certifies that he or she is authorized to agree to the Booking Conditions on behalf of all members of the party, including any changes.
2. The lead name must be over 18 years and a member of the party occupying the property. The lead name agrees to take responsibility for all members of the party.
3. In no circumstances may more than the maximum numbers of persons, as stated in your invoice, occupy the Beach House. Fonterra Lagos reserves the right to make a deduction per head (at a fee to be determined by Fonterra Lagos) from the Caution Fee, refuse admittance or revoke your booking if this condition is not observed. No refunds will be given if admittance has been refused or if your booking is revoked for this reason.
4. Full rentals are for the entire facility for the duration of stay.
5. The outdoor facility can host 100+ people for outdoor events and parties but please note that the 5 Bedrooms indoor facility is limited to 10 sleepover guests, maximum of 2 persons per room.
6. Fonterra Lagos reserves the right to refuse the use of any facilities or amenities on the Beach House if the condition in clause 4 above is not observed. No refunds will be given if use of any facilities or amenities has been refused for this reason.
7. Fonterra Lagos reserves the right to refuse or revoke any bookings from parties that may in their opinion (and at their sole discretion) be unsuitable for the property concerned.

Fees

The Hirer is required to pay the following for the use of the Beach House:

1. Rental fee
2. Caution Deposit
3. Any other additional charges
4. Any government imposed taxes or fees

All jointly referred to as “fees”

Initial Payment

Bookings will be reserved upon receipt by Fonterra Lagos of full payment of the fees or the required deposit payment of 50% of the fees.

Balance Payment

The Balance of the fees is payable before access is given for the use of the Beach House. On receipt of the Balance Payment, confirmation of the booking and directions to the Beach House will be sent to the Hirer. Fonterra Lagos reserves the right to cancel any bookings where full payment has not been received within 7 days from the due date.

Method of Payment

Transfer will be made to the account provided by Fonterra Lagos. Cash payments will not be accepted.

Value Added Tax

VAT applies to the property rental, it will be included in the quoted price at the prevailing rate. Fonterra Lagos charges and VAT inclusive rentals are subject to change if the rate changes.

Cancellation Policy

1. 50% of paid prepayments are refundable when cancelled 14 days before arrival or earlier.
2. No refund applicable if cancelled less than a week.

Rescheduling Policy

Only applicable when your booking is affected by external factors (e.g. government action); and in all cases are at the full discretion of Fonterra Lagos.

Caution Fee

It is a requirement when booking with Fonterra Lagos to pay a Caution Fee. The Caution Fee is due to be paid along with the booking fees, it will be held by Fonterra Lagos and applied against the reasonable costs of miscellaneous repairs to and/or replacement of and/or additional cleaning of furnishings, kitchen equipment, amenities on the Beach House crockery, glass, keys, bedding and towels damaged or soiled otherwise than by usual wear and tear during the period of Hire by you or other members of your party. The balance of the Caution Fee (if any) will be returned to you within 24 hours of the departure date. Where such costs exceed the Caution Fee you will pay such excess to Fonterra Lagos within 14 days of being notified

1. There is a standard flat rate of caution deposit of N200,000 for all bookings.

Your responsibilities

1. You and your invitees must fully comply with the rules and regulations of the Beach House.
2. You are expected to take all reasonable care of our properties. Please ensure the Beach House and all contents are left clean and tidy at the end of your stay and report any breakages or defects.
3. You will be liable for any damage caused to the properties during your booking beyond reasonable ‘wear and tear’. Please tell us about any damage or breakages at the end of your stay, so that we can rectify the situation. We shall charge for damage and repairs. If there is a problem, please contact us during the day, so that we can try to resolve it at the time.
4. In the event of damages caused by you or your invitees, you agree that Fonterra Lagos shall deduct the cost of repair from the caution fee.

Return of Personal Belongings

1. In the event of any items being left in the Beach House, we will collect, pack and post the items back and courier fee will be required to be paid before such belongings can be dispatched to you.
2. Failure to request for items found at the Beach House within 2 days after the date of use of the Beach House Fonterra Lagos shall have a right to discard the belongings.

Booking & Eligibility

All bookings are strictly by reservation only and confirmation must be received before access to the property is granted. The lead guest must be at least 21 years old and present during the stay. A valid government-issued identification is required at check-in. The lead guest assumes full responsibility for all guests, visitors, and vendors associated with the booking. Fonterra reserves the right to decline or cancel any booking at its discretion.

Check-in & Check-out

Check-in for day bookings begins at 11:00 AM and check-out is at 7:00 PM. For overnight bookings, check-in begins at 11:00 AM with check-out at 9:00 AM the following day. Late check-out is subject to availability and must be approved in advance. Early check-out does not entitle guests to extensions, refunds, or compensation.

Guest Capacity & Visitors

Maximum occupancy limits apply to all bookings and guest numbers must be accurately declared at the time of booking. Unauthorized additional guests may result in refusal of entry or eviction from the property. Visitors are only permitted with prior approval, and security personnel reserve the right to deny entry to any unauthorized persons.

House Rules & Conduct

1. Guests are required at all times to treat the Beach House, its furnishings, fittings, equipment, and surrounding areas with due care, respect, and consideration. Any form of misuse, negligence, or intentional damage to the property is strictly prohibited.
2. All guests, invitees, and vendors must conduct themselves in a responsible, orderly, and respectful manner throughout the duration of their stay. Guests remain fully accountable for their own actions and the actions of anyone associated with their booking.
3. Illegal, unlawful, or prohibited activities of any kind are strictly forbidden within the Beach House and its surrounding premises. Any guest engaging in such activities does so at their own risk and shall bear full responsibility for any consequences arising therefrom.
4. Smoking is not permitted inside any indoor areas of the Beach House. Where smoking is permitted outdoors, guests must ensure proper disposal of cigarette waste and maintain cleanliness of the premises.
5. Guests, invitees, and vendors are required to comply with all reasonable instructions, safety guidelines, and operational procedures communicated by Fonterra Lagos staff and security personnel during their stay.
6. No abuse, spraying, defacement, mutilation, or improper handling of the Naira or any other currency is permitted within the facility. Any guest found engaging in such acts shall be solely responsible for any legal, regulatory, or financial repercussions arising from such conduct, in accordance with applicable laws.

Use of Facilities

Use of the swimming pool, beach, and other facilities is entirely at the guest’s own risk, as there is no lifeguard on duty. Children must be supervised at all times. All posted facility rules must be observed, and glass items are prohibited in pool areas. The kitchen, entertainment areas, and all equipment must be used responsibly, and any damage must be reported immediately.

Events, Vendors & Third Parties

Events, parties, and special gatherings require prior approval from Fonterra. All external vendors must be approved in advance, and guests are fully responsible for the conduct and actions of their vendors. Setup and cleanup for events must be completed strictly within the approved booking hours.

Safety & Liability

Guests are responsible for the safety of their personal belongings, and Fonterra is not liable for loss, theft, or damage of personal items. Guests assume all risks associated with the use of the property and its facilities. Any injuries resulting from guest negligence are the responsibility of the guest. All hazards or safety concerns must be reported to management immediately.

Photography & Media

Personal photography for private use is permitted on the property. Commercial photography, videography, or content creation requires prior approval. Drone usage is not allowed without authorization. Guests must respect the privacy of others at all times. Fonterra may request consent before using any guest images or recordings for marketing or promotional purposes.

Privacy & Data Protection

Guest information is collected and used solely for booking and operational purposes. Reasonable security measures are in place to protect personal data, and guest information is not sold or shared with third parties without lawful justification.

Complaints & Disputes

Any issues or complaints must be reported immediately during the stay to allow for prompt resolution. Formal complaints should be submitted within 48 hours after checkout. All disputes arising from the use of the property are governed by the laws of Lagos State, Nigeria.

Modifications & Acceptance

Fonterra reserves the right to update or modify these terms at any time. Continued use of the property constitutes acceptance of the applicable terms. By making a booking, the lead guest confirms their authority to bind all members of their party to these terms and conditions.
